Japan Energy Challenge 2019 Venture Competition Terms and Condition


  1. The Promoter

The promoter is: SMAP Energy Limited at https://japanenergychallenge.com/program/2019-venture-competition/  

  1. The competition
    1. The title of the competition is the Japan Energy Challenge 2019 Venture Competition.
    2. To enter you must be an incorporated business operating in the energy sector.  Approximately twenty entrants will be selected to participate in discussions with the consortium of sponsors of the prize and given the opportunity to promote their product offerings for the Japanese energy sector. Each of those entrants will have the opportunity to attend an event in August in the United Kingdom with specific costs reimbursed1.
    3. Approximately two of those entrants will be offered the competition prize: an opportunity to travel to Japan to pitch to a tailored selection of key decisionmakers with the following benefits:
      • Economy class travel and reasonable accommodation expenses to be reimbursed for one company representative;
      • All supporting services – travel agents, translators, etc;
      • Connections to relevant suppliers, consultants, technical experts, etc. and ongoing support to promote the product offerings to market in Japan;
      • Media coverage for both European and Japanese audiences.
  2. How to enter
    1. The competition will run from 1 January 2019 (the “Opening Date“) to 31 March 2019 (the “Closing Date“) inclusive.
    2. All competition entries must be received by the Promoter at the address set out at condition 1 by no later than 23.59 on the Closing Date. Competition entries received after the Closing Date may be rejected by the Promoter.
    3. To enter the competition, submit the online entry form provided at https://japanenergychallenge.com/program/2019-venture-competition/ by the Closing Date (or otherwise provide such information as the Promoter at its discretion specifies).
    4. By submitting a competition entry, you agree to be bound by these terms and conditions and may be requested to confirm such agreement in writing as a condition to participation in the competition.
    5. Approximately twenty entrants will be selected by a panel set up by the Japan Energy Challenge team (‘JEC Team’) for participation in the UK-based event in August 2019. From those entrants, two (or such number as the Promoter determines in its discretion) entrants will be selected to participate in a sponsor event in Japan. The selection decision of the JEC Team for both stages will be final.
  3. Participation
    1. By submitting a competition entry, you agree that:
      • if you are one of the twenty selected entrants you will work with the JEC Team to collect and prepare materials for dissemination to the sponsors and you will make available a representative of appropriate seniority to attend the August event and support your product offerings2;
      • similarly, if you are one of the entrants selected to travel to Japan, you will make available a representative of appropriate seniority to attend the event and support your product offerings; and 
      • you grant a non-exclusive licence to the Promoter to use all your logos and the materials submitted and developed in the course of the program and any images/photos taken by the Promoter over the course of the program.
    2. As one of the twenty selected entrants, you will have the non-exclusive right to use the Japan Energy Challenge logos solely in connection with your participation in the program and provided that you do not damage the reputation of the Japan Energy Challenge, the Promoter or any sponsor as a result of such use.
  4. Regulatory responsibilities
    • Each entrant will be responsible for ensuring that any persons travelling to the events in the UK and, if selected, Japan as part of the competition hold valid passports and any necessary visas and travel documents for the travel dates.
  5. Confidentiality
    1. Each entrant undertakes that it shall not at any time disclose to any person any information of a confidential nature coming to its attention as a result of the competition (whether relating to any of the sponsors or otherwise), except to its representatives who need to know this information for the purposes of this competition (and for whom the entrant remains responsible at all times).
    2. The Promoter undertakes to take all reasonable steps to ensure that any information of a confidential nature provided to it by an entrant is kept confidential and is only disclosed to such persons as are necessary for the purposes of this competition or as required by law or regulation.
    3. Each party reserves all rights in its confidential information. No rights or obligations in respect of confidential information other than those stated in clause 4 are granted or to be implied from these terms.
  6. Limitation of liability
    • Insofar as is permitted by law,  the sponsors, the JEC Team, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winners or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of any of those persons, their agents or distributors or that of their employees. Your statutory rights are not affected.
  7. Data protection
  8. General
    1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
    2. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
    3. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.


  1. Travel expenses for each entrant (other than companies incorporated in England) will be reimbursed up to 500 GBP.  Accommodation will be reimbursed up to 150 GBP/night for 2 nights, VAT/applicable tax is included in this amount. Travel arrangements are subject to reasonable conditions (including economy class travel only), must be approved in writing in advance, and must be accompanied with supporting documentation (receipts, etc.).  No reimbursement will be made unless the entrant participates fully in the August event.
  2. The sponsors are potential clients for the successful entrants and their representatives will be at executive level.  Accordingly, the entrant will be required to provide a representative typically holding a role equivalent to a business development manager role or higher. S/he must be approved by the Promoter in advance and attendance is conditional upon such approval.  If the approved representative is unable to attend the event, the Promoter must be notified immediately and a suitable substitute provided. Failure to do so may result in the invitation to attend being revoked and no payment being made in respect of the competition.
